I had this same news bit on my mind for a few days, but the Jewish holidays and my Harriet Miers rants got in the way. Glad to see that fellow bloggers like Patterico are on the ball on this and are sympathetic to the cause. (Be sure to read the worthwhile comments under Patterico's post as well.)
The new Shining trailer is indeed pure genius. Any legal regime that would prevent or chill works like this from coming into existence is one in serious need of reform. (Admittedly its just talent agent talking trash right now about what might happen legally. But the regular readers of the "Tyranny of Copyright" series know that trash talk like this often results in actual legal threats.)
Another important point to emphasize once again - The Shining trailer debate is yet another example of the nonsensical distinction that the law tries to make between "parody" (which is allowed under the law) and "satire" (which remains an unlawful violation of copyright). It is this absolute abortion of legal reasoning that ultimately gave rise to Levine's First Rule of Law.
