How could no one catch this in the vetting process?

Firestone at June 20, 2004 08:31 PM (Permalink)He was "without a license" because his idiot staff forgot to renew it; he fixed that with back dues as soon as he learned of the mistake. Absent that screw-up, he'd have been entitled to admission in UT on motion. With it, he had a choice of taking the bar exam, or working closely with licensed attorneys. He opted for the latter. All this was in his capacity as general counsel; he wasn't representing anybody in court.
Ryan thinks it's much ado about nothing. I wouldn't go quite that far, but I would call it much ado about not much.

I don't disagree as to you, but do as to me. Litigating on an out of state license or with an inactive/expired in-state one is unthinkable. Acting as in-house corporate counsel under the circustamances is not, and is in fact quite common. Some states expressly permit attorneys licensed in other states to serve as in house counsel. Utah is not one of those states; however, it does allow non-licensees to work closely with licensed attorneys, which appears to be what Mr. Griffith has done. The WaPo article also indicates that he communicated with the UT Bar enough that they knew what he was up to. If they really thought he was committing UPL, why didn't they go after him?
No. 2 is a fair point, but bear in mind that by advocating it, you are ruling out a lot more in house counsels from future appointments than you may think.
